DEFINITIONS


In the application and interpretation of this agreement, the terms below shall have the following meanings:

​

  • Law: Consumer Protection Law No. 6502

  • Regulation: Regulation on Distance Contracts (Official Gazette: 27.11.2014/29188)

  • Ministry: Ministry of Customs and Trade of the Republic of Turkey

  • Seller: The company listed above that offers goods or services to the consumer in the course of its commercial or professional activities or acts on behalf of or under the account of those who do so.

  • Buyer/Consumer: The real or legal person who acquires, uses, or benefits from a good or service for non-commercial or non-professional purposes as listed above.

  • Website/Site: The online platform “www.fusyajewellery.com” where the Fusya Jewellery brand products are sold.

  • Goods: Movable property that is the subject of the shopping transaction.

  • Service: Any consumer transaction other than the provision of goods carried out or promised for a fee or benefit.

  • Order Placer: A real or legal person who requests goods or services through the Seller’s website.

  • Contract: The terms and obligations of the sales transaction conducted between the Seller and the Consumer via the Site.

SUBJECT OF THE CONTRACT

​

This Distance Sales Contract ("Contract") regulates the rights and obligations of the parties regarding the sale and delivery of the product(s) specified below, ordered by the Buyer electronically from the Seller's website, in accordance with the provisions of the Consumer Protection Law No. 6502 and the Regulation on Distance Contracts.

The essential features of the product(s), including the quantity, type, and model, as well as the total price including taxes and shipping fees, are as follows:

GENERAL PROVISIONS

​

  1. The Buyer declares that they have read and understood the information about the Seller, the product(s) to be purchased, and the essential characteristics of the product(s), including the sales price and payment method, and that they have approved this information electronically.

  2. The Buyer accepts that the product(s) subject to this contract shall be delivered within the statutory delivery period of 30 days from the day following the Buyer’s order, unless otherwise agreed.

  3. The Seller is responsible for delivering the product(s) in a sound, complete, and in accordance with the specifications indicated in the order.

  4. If the product cannot be delivered due to unforeseen circumstances, the Seller shall notify the Buyer immediately. If the Buyer does not wish to wait, they are entitled to cancel the order. In such a case, the Seller shall refund all payments, including shipping fees, to the Buyer within 14 days.

  5. The Buyer agrees to pay the total sales price via the method they selected on the Site.

 

RIGHT OF WITHDRAWAL

  1. The Buyer has the right to withdraw from the contract without providing any justification within 14 days from the delivery of the product(s).

  2. To exercise the right of withdrawal, the Buyer must notify the Seller in writing (e.g., via email or postal mail).

  3. Upon withdrawal, the Buyer must return the product(s) in their original condition, unused, and with all accessories and packaging intact.

  4. The Seller will refund the payment within 14 days of receiving the returned product(s).

 

EXCEPTIONS TO THE RIGHT OF WITHDRAWAL

The Buyer may not exercise the right of withdrawal in the following cases:

​

  • Custom-made products or products prepared according to the Buyer’s requests.

  • Products that cannot be returned due to hygiene or health reasons after the packaging is opened (e.g., earrings).

  • Products that are not suitable for return due to their nature, such as perishable goods.

 

DISPUTE RESOLUTION

​

In disputes arising from this contract, the Consumer Arbitration Committees and Consumer Courts in the Buyer’s or Seller’s locality will have jurisdiction.
